By booking or allowing work to proceed, the client agrees to the following terms and conditions.

Services Provided

  1. Services may include, but are not limited to: grass cutting, hedge trimming, pruning, weeding, border maintenance, leaf clearance, light tree and shrub work, and general garden upkeep.
  2. All services are carried out on a best endeavours basis, taking into account weather conditions, seasonal growth, site conditions, and access.
  3. The service provider reserves the right to refuse or discontinue work where conditions are unsafe, impractical, or outside the agreed scope.

Quotations and Pricing

  1. Quotations are based on visible conditions at the time of quoting.
  2. Prices may be reviewed if garden conditions materially change (e.g. excessive growth, neglect, restricted access, additional obstacles).
  3. Any additional work requested outside the original agreement may incur extra charges, which will be communicated where reasonably possible.

Payment Terms

  1. Payment is due on completion of works, unless otherwise agreed in writing.
  2. Accepted payment methods will be communicated prior to or at the time of service.
  3. Failure to make payment on completion may result in suspension of future services.

Late Payment

  1. Payments not received within 5 days of completion may be considered overdue.
  2. Late payments may incur reasonable administration charges.
  3. Persistent late payers may be required to pay in advance for future visits or have services terminated.

Access to the Property

  1. The client does not need to be present during the visit, provided safe and clear access to the garden is available.
  2. Gates must be unlocked, and pets secured prior to arrival.
  3. If access cannot be gained, the visit may be charged in full or partially to cover time and travel.
  4. The service provider is not responsible for delays or incomplete work due to restricted or unsafe access.

Client Responsibilities

  1. The client must clearly identify boundaries, fragile items, hidden hazards (e.g. cables, irrigation, ornaments), and underground services.
  2. The service provider accepts no liability for damage to items not reasonably visible or disclosed prior to work.
  3. Vehicles, furniture, toys, and personal items should be removed from work areas where possible.

Green Waste Removal

  1. Green waste can be removed upon request.
  2. Waste removal is charged at £15.00 per 500 - litre bag / 2 garden bin equivalent, unless otherwise agreed.
  3. Waste will be disposed of responsibly in accordance with UK waste regulations.
  4. If waste removal is not requested, green waste will be left neatly on site where practical.

Tools and Equipment

  1. All reasonable care is taken when using professional gardening tools and machinery.
  2. The service provider shall not be held liable for minor incidental damage where reasonable care has been exercised (e.g. small stone chips, minor turf marking).
  3. Work may be postponed or adjusted due to equipment failure, adverse weather, or safety concerns.

Weather and Seasonal Conditions

  1. Gardening is weather dependent. Services may be rescheduled due to rain, frost, high winds, heat, or unsafe ground conditions.
  2. Seasonal variation in growth may affect appearance, frequency, and duration of visits.

Damage and Liability

  1. The service provider holds appropriate public liability insurance.
  2. Liability is limited to the cost of rectifying direct damage caused by negligence, where proven.
  3. The service provider is not liable for:
  • Pre-existing damage or poor plant health.
  • Loss of plants due to weather, pests, disease, or seasonal decline.
  • Damage caused by undisclosed hazards.
  • Indirect or consequential losses.

Complaints

  1. Any concerns must be raised within 48 hours of the visit.
  2. Reasonable opportunity must be given to inspect and, where appropriate, rectify any issues.

Cancellations

  1. Cancellations should be made with as much notice as possible.
  2. Late cancellations may be subject to a charge to cover time and travel costs.

Ongoing Maintenance Visits

  1. For regular maintenance, visit frequency may be adjusted to suit seasonal growth.
  2. Missed visits due to weather, access, or client request may not always be replaceable.

Termination of Services

  1. Either party may terminate services at any time.
  2. Outstanding payments remain payable following termination.

Governing Law

  1. These Terms and Conditions are governed by the laws of England and Wales.
